Welcome to the NATION MARKETPLACE, owned, created, and operated by NATION MARKETPLACE (NATION MARKETPLACE, NATIONMARKETPLACE.COM web site and NATION MARKETPLACE, LLC are collectively referred to as "NATION MARKETPLACE"). NATION MARKETPLACE makes available a variety of products and services through NATION MARKETPLACE.COM (collectively, the "Products and Services") subject to these Terms and Conditions that include any other posted guidelines or rules that may be applicable to any individual NATION MARKETPLACE web site and/or NATION MARKETPLACE Products and Services  ("Terms and Conditions").

Because the Terms and Conditions contain legal obligations, please read them carefully.

Trademarks of the Nationmarketplace.com Web Site

The name “NATION MARKETPLACE” and other NATION MARKETPLACE marks, service marks, logos, designs, phrases, and any other such marks used and/or displayed on the web site in connection with our Products and Services are the trademarks, service marks, and trade dress of NATION MARKETPLACE (collectively, “Trademarks”) on the NATION MARKETPLACE web site. They are NATION MARKETPLACE’s registered trademarks or those of third parties lawfully contracted with NATION MARKETPLACE. Nothing contained in the web site should be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on the web site without our express written permission or that of the appropriate third party that owns the Trademark. Except as permitted by these Terms and Conditions, any unauthorized use of the Trademarks is prohibited. Some actions that may be considered infringements of such Trademarks are reproduction in any form, copying and/or displaying, reverse engineering, decompiling, disassembling, and/or making derivative works from Trademarks that belong to NATION MARKETPLACE or a third party whose Trademarks are lawfully in use on the NATION MARKETPLACE web site.


Definitions

The term “Customer or Supplier” is described as the person, individual or commercial entity who submits an online application by clicking the “Sell” icon on the NATION MARKETPLACE homepage, successfully paying a membership fee to list products or purchases advertising on the web site (“Third Party Content”) and is approved by NATION MARKETPLACE to do so.  


The term “Buyer” is described as the person, individual or commercial entity who is requesting to communicate with Customer or Supplier and/or to purchase any of Customer’s or Supplier’s Products and Services. The Buyer submits an online verification form to NATION MARKETPLACE by clicking the “Buy” icon for use of the NATION MARKETPLACE Products and Services.  The Buyer does not pay the NATION MARKETPLACE any fee(s). Buyer acknowledges and agrees that Buyer alone must evaluate, and bear all risks associated with, the use or validity of any Third Party Content, including any reliance on the accuracy, completeness, or usefulness of such Third Party Content. In this regard, Buyer acknowledges that Buyer may not rely on any Third Party Content created by or obtained through the use of NATION MARKETPLACE Products and Services as absolute. For more information, see the Disclaimer section below.


The term “User” is described as all persons, individuals, or commercial entities who utilize the NATION MARKETPLACE Products or Services, whether as a Visitor, Buyer or a Supplier. In this sense, the verb “use” may refer to browsing the web site for any reason, signing up for promotions and discounts, a listing of Products or Services or the purchase of any Products or Services.


Acceptance

By using the NATION MARKETPLACE web site, you (the “User”) agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to any individual NATION MARKETPLACE web site Products or Services.

You represent and warrant that, for all content you provide, or any links to such content you provide on the NATION MARKETPLACE web site, that you are the legal owner of such content and have the necessary right to upload such content and/or links and to meet your obligations under this Terms and Conditions agreement.

You waive, to the fullest extent permitted under applicable law, your right to enforce your intellectual property rights in that content against NATION MARKETPLACE or its subsidiaries, designees, affiliates, or business contractors, or to other third parties, including but not limited to any owners, officers, directors, or board of directors, or any other employees of NATION MARKETPLACE.


Conditions and Restrictions on Use and Liability

Use of the Products and Services is subject to compliance with these Terms and Conditions. You acknowledge and agree that NATION MARKETPLACE may terminate your access to NATION MARKETPLACE or to any of the Products and Services should you fail to comply with the Terms and Conditions. Any such termination shall be in NATION MARKETPLACE's sole discretion and may occur without prior notice, or any notice. NATION MARKETPLACE further reserves the right to terminate any User's access to NATION MARKETPLACE or to any of the Products and Services for any conduct that NATION MARKETPLACE, in its sole discretion, believes is or may be directly or indirectly harmful to other Users, to NATION MARKETPLACE or its subsidiaries, designees, affiliates, or business contractors, or to other third parties, including but not limited to any owners, officers, directors, or board of directors, or any other employees of NATION MARKETPLACE, or for any conduct that violates any local or foreign laws or regulations related to any Customer or Supplier of NATION MARKETPLACE.

Further, NATION MARKETPLACE, its subsidiaries, designees, affiliates, business contractors, owners, managers, officers, employees, other third parties, and agents will have no liability for any damages, including, without limitation, direct, indirect, consequential, compensatory, special, punitive, or incidental damages arising out of or relating to the use of, reliance on, or inability to use the NATION MARKETPLACE web site or the content on the site, including any damage arising in connection with any failure, interruption, or delay in operation or transmission, or system failure, including power outages and/or failure of your Internet Service Provider (ISP) outage.

NATION MARKETPLACE may suspend or terminate, in its sole discretion, any Buyer account for any Product or Service because of Buyer inactivity. For example, a NATION MARKETPLACE account may be terminated or suspended if a Buyer fails to sign-in to NATION MARKETPLACE for an extended period of time.

NATION MARKETPLACE may suspend or terminate, in its sole discretion, any Customer/Supplier account for any Product or Service once a fee-paid period has expired and without receipt by NATION MARKETPLACE of payment for renewal of next period. 

You agree to indemnify and hold NATION MARKETPLACE, its owners, officers, employees, and/or agents harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees and costs, due to or arising from, (i) your use of the web site; (ii) your breach of these Terms and Conditions; or (iii) your violation of any right of any third party lawfully contracted with NATION MARKETPLACE.

Use of the mobile application (“Mobile App”) for NATIONMARKETPLACE.COM, its Terms and Conditions, and all policies and additional terms posted on the web site are incorporated into this Terms and Conditions agreement.

You authorize NATION MARKETPLACE to use standard, automated tools to translate your postings and linked web pages in whole or in part, into local languages where and when such translations are available. Upon your request, we may be able to provide you with such language-translation tools to enable you to translate content. NATION MARKETPLACE cannot guarantee the accuracy of such translations or the availability of a translation tool for a specific language.


Cookies and “Web Beacons”

NATION MARKETPLACE may collect cookies (“Cookies”) sent to your Internet browser from our web site or any web site you may visit. These Cookies may be used to provide aggregated statistics about the NATION MARKETPLACE web site’s visitors, but such information does not identify you personally and may help us adjust content of the web site to provide better service to our web site visitors. If you set your browser to refuse Cookies, you can still access most of the NATION MARKETPLACE web site, but you may not be able to conduct some types of transactions.

The NATION MARKETPLACE web site may contain digital images known as web beacons (“Web Beacons”) that can assist us in counting visitors to our web site. 


Registration and Privacy

Certain of the Products and Services will require the User to register and provide certain data to NATION MARKETPLACE. In consideration of use of such Products and Services, in registering and providing such data, you represent and warrant that: (a) The information about yourself is true, accurate, current, and complete (apart from optional items) as required by NATION MARKETPLACE registration forms ("Registration Data"); (b) You will maintain and promptly update the Registration Data to keep it true, accurate, current, and complete at all times, as reasonable circumstances permit. If you provide any information that is untrue, inaccurate, not current or incomplete, or NATION MARKETPLACE has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, NATION MARKETPLACE has the right to suspend or terminate your account and refuse any and all current and/or future use of the Products and Services; and (c) If you are an individual, you must be 21 years or older to use the NATION MARKETPLACE service and by registering, you represent that you are 21 years or older. We may require at any time that you provide evidence of your age. Failure to provide such evidence of age, if requested, may result in the immediate closure of your application or account.

All NATION MARKETPLACE registrations become the exclusive property of NATION MARKETPLACE and its subsidiaries. NATION MARKETPLACE reserves the right to use and reuse all registration and other personally identifiable user information, for the purpose of contacting our clients regarding, for example, such things as marketing, discounts, and other important notices and information. Users may edit, update, alter or obscure their personally identifiable information at any time by following the instructions located in NATION MARKETPLACE sites.


User Conduct

As a User of the NATION MARKETPLACE Products and Services, you are responsible for maintaining the confidentiality of your password and Identification Information (“ID”), and are fully responsible for any or all activities that occur through the use of your password or ID. You agree to 

     (a) immediately notify NATION MARKETPLACE of any unauthorized use of your password or account or any other breach of security, and 

     (b) ensure that you exit and/or log out from your account at the end of each session on the NATION MARKETPLACE web site. 

NATION MARKETPLACE cannot and will not be liable for any loss or damage of any kind, including punitive damages, arising from your failure to comply with this requirement.

In addition, you will not transfer your NATION MARKETPLACE membership, account information, ID or password to another party without the prior written and express permission of NATION MARKETPLACE.

You acknowledge and agree that all information, code, data, text, software, music, sound, photographs, pictures, graphics, video, chat, messages, files, or other materials including links ("Third Party Content"), whether publicly posted or privately transmitted, are the sole responsibility of the User from which such Third Party Content originated. This means that you, and not NATION MARKETPLACE, are entirely responsible for all Third Party Content that you upload, post, email, or otherwise transmit via the Products and Services. NATION MARKETPLACE does not control the User or any Third Party Content posted via the Products and Services, and, as such, does not guarantee the accuracy, integrity or quality of such User or Third Party Content. 

You acknowledge and agree that by using the Products and Services, you may be exposed to Third Party Content that is offensive, indecent, or objectionable. Under no circumstances will NATION MARKETPLACE be liable in any way for any User or Third Party Content, including, but not limited to, any errors or omissions in any such Third Party Content, or for any loss or damage of any kind incurred as a result of the use of any such Third Party Content posted, emailed, or otherwise transmitted via the Products and Services, including punitive damages. As a general matter, NATION MARKETPLACE does not pre-screen user or Third Party Content posted on the NATION MARKETPLACE web site, except for some web site areas where NATION MARKETPLACE may employ specific automated screening software, although NATION MARKETPLACE reserves the right to do so. NATION MARKETPLACE does not guarantee that any screening will be done to your satisfaction or that any screening will be done at all. NATION MARKETPLACE reserves the right to monitor some, all, or no areas of the Products and Services on its web site for adherence to these Terms and Conditions or any other rules or guidelines posted by NATION MARKETPLACE.


Refund Policy

NATION MARKETPLACE addresses concerns and complaints in accordance with the above-listed Terms and Conditions of use.  

Web site Users are encouraged to review the above statement and in the event of partial and/or complete disagreement with the Terms and Conditions stated, we recommend immediate termination of use and/or withdrawal from the use of the NATION MARKETPLACE web site and/or the Products and Services listed.

The NATION MARKETPLACE does not offer Customer refunds after Customer purchases a membership. Similar to buying a software license, all sales are final. Web site Users are encouraged to check back periodically to stay informed of any changes to the Terms and Conditions that may be amended from time to time at any time and constitute the entire Agreement, and supersede any other agreements or understandings (oral or written), between the platforms and web site Users.

 

Prohibited Conduct

Customers agree not to use NATION MARKETPLACE Products and Services to:

     1. Upload, post, email, otherwise transmit, or post links to any content, or select any member or user name or email address that is unlawful, harmful, pornographic, or otherwise objectionable.
 
     2. Collect or store personally identifying information about other Users for any purposes.

You acknowledge and agree that NATION MARKETPLACE and its designees shall have the right (but not the obligation), in their sole discretion, to refuse to publish, and/or to remove or block access to any Third Party Content that is available via the Products and Services at any time, for any reason, or for no reason at all, with or without notice. NATION MARKETPLACE may also terminate access to, or membership in NATION MARKETPLACE, or any portion thereof, for violating any of the Terms and Conditions. 

You expressly acknowledge and agree that NATION MARKETPLACE may preserve Third Party Content and may also disclose Third Party Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms and Conditions; (c) respond to claims that any Third Party Content violates the rights of  additional parties, including Customers and/or Users; or (d) protect the rights, property, or personal safety of NATION MARKETPLACE or its subsidiaries, designees, affiliates, or business contractors, or to other third parties, including but not limited to any owners, officers, directors, or board of directors, or any other employees of NATION MARKETPLACE, its Users, and the public. You acknowledge and agree that the technical processing and transmission of the Products and Services, including your Third Party Content, may involve (a) transmissions over various networks; and (b) changes to software coding to conform and adapt to technical or legal requirements of connecting networks or devices.

You expressly acknowledge and agree not to use or launch any automated system, including without limitation, any robots, spiders, offline readers, scrapers, data mining tools, data gathering and/or extraction tools or other automated or otherwise means to access our Products and Services or any part of the NATION MARKETPLACE web site for any purpose, except with prior written and express permission of NATION MARKETPLACE.


License to Customer Web Pages and Other Content

By submitting a web page to NATION MARKETPLACE, or any other web page hosting service on NATION MARKETPLACE, you grant NATION MARKETPLACE a worldwide, royalty-free, nonexclusive, unrestricted license to use, copy, transmit, publicly display, publicly perform, create compilations including distribution of such web page, and any associated Third Party Content, for the limited purposes of publishing and promoting the User's web page in connection with the particular service with which the User has chosen to have the web page hosted and for publishing and promoting such web page elsewhere within NATION MARKETPLACE. Such license shall apply with respect to any form, media, or technology now known or later developed. 

Be aware that NATION MARKETPLACE may remove or alter any metatags and URL links included in any listing for the purposes of ensuring, to the fullest extent possible, clean connections and User ease.

The term of the license will extend only for the duration of the Customer's membership with the particular NATION MARKETPLACE service. You acknowledge and agree that NATION MARKETPLACE runs advertisements on the web pages of its Customers and grant NATION MARKETPLACE the right to do so. These advertisements may include, without limitation, "banner" advertisements and "pop-up text" advertisements or displays as featured products that rotate throughout the site. The manner, mode, and extent of such advertising is subject to change and design in the sole discretion of NATION MARKETPLACE.

Information on the NATION MARKETPLACE web site may contain inaccuracies or typographical errors. Information may be changed or updated without notice.

NATION MARKETPLACE makes no representations whatsoever about other web sites which you may access through this one. When you access a non-NATION MARKETPLACE web site, please understand that it is independent from NATION MARKETPLACE, and that NATION MARKETPLACE has no responsibility for, or control over, the content on that web site.

In addition, a link to a non-NATION MARKETPLACE web site does not mean that NATION MARKETPLACE endorses or accepts any responsibility for the content, use, or products and services made available through such web site, or any failures of the software programs,  coding, or links on the non-NATION MARKETPLACE web site.

The NATION MARKETPLACE will perform due diligence to manage the risk of nefarious acts caused by third parties, hostile governments or through criminal means to illegally gain information and/or monies, or disrupt services.  In order to counteract these activities, we have employed world-class security measures along with backup redundancy systems to protect content, data, and privacy information.  However, the NATION MARKETPLACE cannot fully guarantee that hostile acts or forces of nature such as earthquake, flood, electromagnetic pulse (EMP), or other such events affecting NATION MARKETPLACE or its third-party service providers will not cause a disruption in service, performance or content and information loss.  Therefore, if such an event was to take place the Customer, Supplier, Buyer or collectively the “User” agrees to hold harmless NATION MARKETPLACE for any damages incurred for loss of content, data, or privacy information.

FUTHERMORE, IN NO EVENT WILL NATION MARKETPLACE BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, COMPENSATORY, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THE NATION MARKETPLACE WEB SITE, OR ANY OTHER HYPERLINKED WEB SITE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA OR OTHERWISE, EVEN IF NATION MARKETPLACE IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(LITHUANIANTRADECOUNCIL.COM) HAS MIGRATED PRODUCT CONTENT FROM THE LITHUANIAN MARKETPLACE ONTO THE NATION MARKETPLACE.  IN NO EVENT WILL NATION MARKETPLACE BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, COMPENSATORY, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THE NATION MARKETPLACE WEB SITE.  THIS AGREEMENT SUPERSEDES ANY AND ALL PREVIOUS AGREEMENTS THAT A SELLER MAY HAVE HAD WITH THE LITHUANIAN TRADE COUNCIL WHETHER CONSTRUED IN WRITING OR VERBAL.     

If any content promoted under LITHUANIA requires changes, updates, or removal from the NATION MAKETPLACE, please contact a LITHUANIAN TRADE COUNCIL representative or the NATION MARKETPLACE customer service team.  LITHUANIAN TRADE COUNCIL suppliers will be provided complimentary “login credentials” to access their existing store to make changes, and/or add or delete products.   

Product Listing Policy

NATION MARKETPLACE is the ideal site for business-to-business commercial transactions. Honesty and high ethical standards are what we represent. Postings on this site should clearly represent the item or items being sold.


1. GENERAL PROHIBITIONS

THE NATION MARKETPLACE SERVES THE GLOBAL COMMUNITY.  ALTHOUGH WE ARE BASED IN THE UNITED STATES, WE HAVE AN OBLIGATION TO RESPECT THE TRADITIONS, CUSTOMS, AND WAY OF LIFE FOR ALL NATIONS. WHAT MAY BE ACCEPTIBLE IN THE UNITED STATES MAY BE OFFENSIVE IN ARAB AND OTHER COUNTRIES; THEREFORE, NATION MARKETPLACE RESERVES THE RIGHT TO REMOVE ANY PRODUCT THAT IS DEEMED OFFENSIVE BY OUR USERS REGARDLESS IF IT IS DEEMED LEGAL AND ACCEPTED IN THE UNITED STATES, BUT NOT CONSTRUED AS ACCEPTIBLE IN ANOTHER COUNTRY. 

The lists below by category are not fully inclusive, and NATION MARKETPLACE, in its exclusive and sole discretion, reserves the right to impose extra prohibitions and restrictions, at any time.

1.1   The NATION MARKETPLACE operates according to the laws of the United States and is prohibited or restricted to sell products which do not adhere to local, state, or federal law. The NATION MARKETPLACE web site also serves as an international marketplace; therefore, if you are posting or selling products from outside of the United States, it is important that you also adhere to the laws within the region, country, municipality, or jurisdiction in which you reside. Below are listed certain categories of restricted or prohibited items. However, this listing is not complete; you, as the Customer, are solely responsible for ensuring that you are not posting a product that may be prohibited by any law governing domestic or international trade.

 1.2 NATION MARKETPLACE prefers to restrict, in addition, the posting of further types of items that may not be prohibited or restricted by law, yet are still marked by controversy including:

  • Items which promote unauthorized activities;
  • Items which are ethnically, religiously, or racially derogatory, or that encourage or promote violence, hatred, religious, or racial intolerance. Listings that can be racially or ethnically offensive are forbidden on the NATION MARKETPLACE web site. Customers and Buyers need to ensure that any choice of words used in their listings, portrays an appropriate level of responsiveness to individuals who could read it, when they may be promoting or buying potentially offensive products or services. In addition, NATION MARKETPLACE forbids such types of Customer advertising or product listings referencing Nazism, the KKK, or any organization or group worldwide that could potentially promote hatred and/or violent activities;
  • Contests, raffles, giveaways, or lotteries;
  • Investment interests, bonds, stocks, and other securities;
  • Pornographic items or materials that are sexual in nature;
  • Items which will not likely offer you a service or product for sale, such as the commercials exclusively meant for obtaining user details.

 

2. ARTIFACTS

2 .1   Artifacts, social relics, traditional grave markers, and all other affiliated products or items are conserved under the laws of the United States, along with other jurisdictions and cannot be sold, traded, or posted by means of the NATION MARKETPLACE web site.

 

3. CURRENCY AND STAMPS

NATION MARKETPLACE strictly forbids the purchase, trade, and/or sale of the following items in 3.1 and 3.2:

3 .1 Foreign exchange or any kind, bank notes, coins, money orders, bonds and bearer bonds, checks and cashier’s checks, including any other currency in any tangible form available now and in the future, currency in digital or any of the intangible forms available now and in the future (i.e., crypto currency ), share and stock certificates in publicly traded or privately held companies, promissory notes, loan documents, along with other securities including titles to tangible properties and other items, in addition to the products employed to generate such items. NATION MARKETPLACE also forbids listings that offer financial services, such as issuing bank guarantees, money transfers and letters of loans, credit, funding and fundraising for personal investment purposes, investment interest, credit or other securities, etc.

3 .2 Counterfeits of the recognized articles in 3 .1; legalized stamps and tenders are totally prohibited.

3 .3 Replicas or reproductions of coins as the collectible products need to be well marked with the expression "COPY," "REPLICA," or "REPRODUCTION" and abide by all of the pertinent local laws.

  

4. THIRD PARTY CONTRACTS 

4.1 Customers are accountable for ensuring that their current transactions are legitimate and not in violation of the contractual obligations. Before listing a product on the NATION MARKETPLACE web site, you must thoroughly read any agreements or obligations that may restrict your own right to promote your item on the NATION MARKETPLACE web site. Certain items, such as dated food products, have expiration dates imprinted on the packaging which could minimize or restrict your ability to promote those products. In additional cases, for example, while you are importing a company's merchandise, you might have signed an additional agreement restricting your capacity to export or sell the listed product in another country, region, or municipality.  If you have entered into a dealer agreement that specifies you are only able to sell products within a territory such as the United States, but not for export to another region, country, or municipality, the Customer should include a disclaimer statement in their product description such as “Sales of this product are only intended for U.S. domestic shipments only,” or another similar statement that describes the limitations on sale and distribution accurately.


NATION MARKETPLACE does not have the ability nor will it accept such responsibility to look for items that could promote such kinds of concerns, nor can NATION MARKETPLACE evaluate print-outs or digital versions of private legal agreements or adjudicate or obtain sides in private commitment conflicts. For this reason, we ask you to keep in mind that posting products in violation of your current contractual obligations might place you at an increased risk with any third parties with whom you have agreements or contracts. Thus NATION MARKETPLACE urges that you choose and not list any specific product until you finally have examined any pertinent agreements or contracts, and are assured you may officially market it on the web site. In case you have any queries with regards to your legal rights under a legal contract or agreement with a third party, we strongly suggest that you get in touch with the service provider with whom you registered into such agreement and/or discuss your obligations with legal representation.

 

5. CREDIT CARDS

5 .1 Credit or debit cards are not allowed to be lawfully distributed (buy, sell, or trade) from one individual to another. It is prohibited to list these items on the NATION MARKETPLACE web site.

 

6. ILLEGAL DRUGS & ASSOCIATED PARAPHERNALIA

6 .1 The sale, trade, or listing of steroids, narcotics, poppy seeds and their products or other controlled substances (such as all drugs outlined in Schedules I , II , III , IV or V of the Uniform Controlled Substances Act , 21 U.S.C . 801 et seq.) is precisely restricted on the web site. Such prohibitions also include any illegal drugs or products, and/or legal controlled substances and associated paraphernalia in any U.S. state or commonwealth, or any other region, country, or municipality worldwide, whether commercially available or through illegal manufacture.


7. PRESCRIPTION DRUGS

7.1 NATION MARKETPLACE does not permit the posting of prescription drugs. If you are uncertain as to whether your item is permitted, please contact NATION MARKETPLACE prior to posting.

7.2 NATION MARKETPLACE does not permit the posting of psychotropic drugs and narcotics, or any derivatives of such drugs or narcotics.

7.3 Customer may post over-the-counter drugs if you have obtained necessary approval, license, or permit to manufacture or sell drugs. If you are uncertain as to whether you may post over-the-counter drugs, please contact NATION MARKETPLACE prior to posting.

 

8. EVENT TICKET RESALE POLICY

8 .1 NATION MARKETPLACE prohibits event ticket purchases, sales, and/or trading on the NATION MARKETPLACE web site.

 

9. NON-LICENSED BRANDING, LOGOS, FACES, NAMES, AND SIGNATURES

9 .1 Non-licensed items possessing the name, branding, signature, image, or likeness of a  person are disallowed, except in cases where the products were manufactured or approved by the particular person or company whose name, branding, signature, image, or likeness have been approved (legally licensed) or used in the mainstream as royalty free, non-licensable product. See Section 26 below “REPLICA AND COUNTERFEIT ITEMS” for additional guidelines pertaining to the use of the NATION MARKETPLACE web site.


10. FIREARMS, AMMUNITION, WEAPONS

10.1 The posting of, promoting for sale, trade, or offering for investment decision, of any arms, military ordnance, ammunitions, weapons (including explosive weapons or devices), and/or any relevant parts or accessories is stringently forbidden. Such activity may result in your account being delisted and/or may include written referral to appropriate legal authorities.

10.2 NATION MARKETPLACE will not permit the posting, promoting for sale, trade, or offering of investment, of BB guns, air guns, stun guns, paintball guns, spear guns, harpoons, or any other weapons that will release a projectile having any chemicals, gas, or other explosive substances, including but not limited to such items as tear gas, bear spray, pepper spray. Replica "look-alikes” and products imitation of the above items under particular circumstances would be authorized solely upon the express sanction of NATION MARKETPLACE.

10.3 Any instruction, processing, servicing, or aid of producing any chemical, biological, or nuclear weapons, or any other Weapons of Mass Destruction (“WMD”) or its known related agents is strictly prohibited by global law and is prohibited on the NATION MARKETPLACE web site. Any violation of this policy will generate a notification to relevant government authorities by the NATION MARKETPLACE along with your account being delisted and closed.

10.4 Knives, along with cutting instruments, will typically be authorized on a case-by-case basis upon NATION MARKETPLACE’s examination, in its sole discretion. Gravity knives, switchblade knives, bladed hand-held devices, knuckledusters (bladed or not), brass knuckles, and disguised knives are not permitted to be listed. NATION MARKETPLACE retains sole discretion over precisely what products are approved and triggers removal of a listing that it deems as a weapon.

10.5 – Weapon-making books, instructions or kits for bomb/explosive-making devices is prohibited. NATION MARKETPLACE retains sole discretion of review and/or potential approval of components of bombs and any improvised explosive device (“IED”), taking into consideration a Customer or User’s licensed commercial documentation for the legal use of such components. 

 

11. FOODS

11.1 The sale, trade, or listing of sexual enhancement supplements, animal parts in any form, or foods is prohibited on the NATION MARKETPLACE web site.

 

12. TOBACCO PRODUCTS

12.1 The posting for sale, trade, or listing of tobacco products, including but not limited to cigarettes, cigars, pipe tobacco, cigarette tobacco, chewing tobacco, tobacco leaf, and hookah tobacco is forbidden on the NATION MARKETPLACE web site.

 

13. GOLD, SILVER AND OTHER PRECIOUS METALS

13.1 NATION MARKETPLACE does not permit listings that offer the sale, trading, or buying of gold, silver and other precious metals (not including jewelry).

 

14. GOVERNMENT-ISSUED IDs, LICENSES AND UNIFORMS

14 .1 The following items may not be listed on the NATION MARKETPLACE web site for sale and/or trade:

  • Items that claim to be, or appear similar to, official government-issued identification documents or licenses, such as birth certificates, driver’s licenses, state or provincial or regional identification cards, visas, or passports. Furthermore, completed applications for such documents containing personal information may not be listed.
  • Fake identification cards or any items that are designed for the manufacture of such cards.  
  • Fake identification cards or any items that represent the coverage for insurance or health care claims.
  • Articles of clothing or identification that claim to be, or appear similar to, official government- and/or military-issued uniforms.  
  • Military awards, decorations and medals, in addition to items with substantially similar designs.

14.2 The posting for sale or trade of official law enforcement equipment or law enforcement identification badges from any public authority, including identification badges issued by the government of any country or municipality, and also including any forged, fraudulent, and/or counterfeit of such identification cards, items, and/or badges, is strictly prohibited. Any such forged, fraudulent, and/or counterfeit law enforcement identification cards, items, and/or badges are also strictly prohibited, and any such forged, fraudulent, and/or counterfeit items will be immediately reported to the appropriate law enforcement agency with jurisdiction over such items, whether local, regional, national, international, and/or other appropriate law enforcement body.

14.3 There are some limited police items that may be listed on the NATION MARKETPLACE web site, provided they observe the noted guidelines:

  • Authorized general souvenir items, such as mugs, hats, buttons, pins, pens, T-shirts, cuff links, money clips that do not resemble badges, and paperweights that do not contain identification information and/or photographs or badge details similar to actual badges.
  • Badges that are clearly not official or genuine (e.g., toy badges).
  • Historical badges that do not resemble modern law enforcement badges, provided that the item description clearly states that the badge is a historical piece at least 75 years old or issued by an organization that no longer exists.

14.4 Police uniforms are prohibited and may not be listed for sale, trade, or use on the NATION MARKETPLACE web site.
 

15. HAZARDOUS AND DANGEROUS MATERIALS

15.1 The posting, offering for purchase or trade, or promoting for sale of dangerous or hazardous materials (such as the categories of dangerous goods as defined under the International Maritime Dangerous Goods Code) is banned on the NATION MARKETPLACE web site.

15.2 The posting of any products containing harmful substances (for example, but not limited to, toys and any other items containing lead paint) is forbidden on the NATION MARKETPLACE web site.

15.3 Automotive airbags are expressly forbidden in listings for sale or trade on the NATION MARKETPLACE web site due to their containing explosive materials.

15.4 Asbestos materials and/or products containing asbestos are prohibited for sale or trade on the NATION MARKETPLACE web site.

 

16. HUMAN PARTS AND REMAINS

16.1 NATION MARKETPLACE prohibits the listing on NATION MARKETPLACE web site for sale or trade of any humans, the human body, or any human body part. Examples of such prohibited items include but are not limited to: organs, bones, blood, sperm, and eggs.

 

16.2 Genuine human skeletons and skulls are prohibited in listing for sale or trade on the NATION MARKETPLACE web site.  Skeletons must be made of plastic or resin materials with this information in the product description, for educational, medical, or for holiday decoration purposes, may be listed on the NATION MARKETPLACE web site as long as the composition of materials is referenced in the product description.

16.3 Items made of human hair, such as wigs for commercial uses, are permitted to be listed for sale on the NATION MARKETPLACE web site.


17. JOB POSTINGS

17.1 Job postings and listings from which a company/factory/institute may directly recruit employees are prohibited on the NATION MARKETPLACE web site.

 

18. MAILING LISTS AND PERSONAL INFORMATION

18.1 The listing for sale or trade, or the posting of bulk mailing lists or emails that contain personally identifiable information including names, addresses, telephone numbers, fax numbers, and email addresses, is strictly prohibited. Also prohibited are software or other tools which are designed or used to send unsolicited commercial email (i.e., "spam"). Any customer found to use such prohibited software for the above purposes shall be immediately and permanently barred from the NATION MARKETPLACE web site.

 

19. MEDICAL AND HEALTHCARE SERVICES

19.1 NATION MARKETPLACE prohibits listings that offer healthcare or medical services, including but not limited to services for medical treatment, vaccination, rehabilitation, psychological counseling, plastic surgery, dietetics, massage, or any other health or medical service, etc.

 

20. NON-BUSINESS INFORMATION

20.1 NATION MARKETPLACE is an online business-to-business information platform; personal and non-business information is prohibited, including the use of the NATION MARKETPLACE web site as a method of personal information exchange or other communication not related to the business-to-business information.

 

21. NON-TRANSFERABLE ITEMS

21.1 Non-transferable items may not be sold or traded, or posted via the NATION MARKETPLACE web site. Examples include products including but not limited to, airline tickets, lottery tickets, and some event tickets may not be transferred or resold.


22. PORNOGRAPHIC MATERIALS AND ADULT PRODUCTS

22.1 The listing of pornographic materials is strictly prohibited, as it violates laws in many countries, and therefore may not be listed on the NATION MARKETPLACE web site. While pornography is difficult to define and standards vary from nation to nation, NATION MARKETPLACE will generally follow guidelines accepted in the United States.  

22.2 NATION MARKETPLACE strictly prohibits items suggestive or depicting of bestiality, rape sex, incest or sex with graphic violence or degradation, and any items depicting or suggestive of sex involving minors.

22.3 NATION MARKETPLACE does not permit the listing or sale and/or trade of sexual materials, including but not limited to, novelty sexually explicit items, including various types of toys, collectibles, or food items in the shape of genitalia. 

22.4 In determining whether listings or information should be removed from the NATION MARKETPLACE web site, we consider the overall content of the posting, including photos and graphics, pictorials, and text.


23. POSTING ADVERTISEMENTS IN LIEU OF A PRODUCT

23.1 The NATION MARKETPLACE offers access to membership so Customers can showcase products as a part of our global community. It is prohibited to substitute the use of a product page with creation of an advertising page.  This includes the creation of a political campaign ad, request for donations (i.e., Go Fund Me), advertising a public and private event or for collecting User information or raising money, etc.  If the Customer would like to advertise on the site, please contact Customer Care for more information.

 

24. REAL ESTATE

24.1 A real estate posting for sale, rent, trade, or otherwise is prohibited on the NATION MARKETPLACE web site at this time.

 

25. REFURBISHED PRODUCTS

25.1 The sale, lease, and purchase of refurbished computers, laptops, and mobile or cellular/smart phones is prohibited on the NATION MARKETPLACE web site.

 

26. REPLICA AND COUNTERFEIT ITEMS

26.1 Listing of counterfeits, unauthorized items, or non-licensed replicas, (i.e., counterfeit designer garments, shoes, jewelry items, handbags, sunglasses, watches, or other accessories), is strictly prohibited on the NATION MARKETPLACE web site.

 26.2 If the products sold bear the logo or name of a company but did not originate from or were not endorsed or licensed by that company, such products are considered counterfeit and unauthorized, non-licensed replicas and are prohibited from listing for sale or trade on the NATION MARKETPLACE web site.

 26.3 Listing products for sale on the NATION MARKETPLACE web site of luxury brands is permitted if an authorization certificate has been issued by the luxury brand owner.

 26.4 Postings offering to purchase or sell counterfeits, replicas, or other unsanctioned and/or unlicensed items shall be subject to removal by NATION MARKETPLACE in its sole discretion. Repeated postings of unauthorized items or counterfeits shall result in the immediate suspension of your membership.

 

27. CIRCUMVENTION DEVICES AND HACKING EQUIPMENT

27.1 Descramblers or other items that may be used to gain unlawful access to television programming (such as cable TV and satellite), telephone, Internet access, data or other restricted, protected, or premium services are strictly forbidden for listing on the NATION MARKETPLACE web site. Stating the product is for test or educational purposes will not legitimize a product that is otherwise inappropriate. Some examples of items which are prohibited include card programmers and smart cards (SD cards), DSS emulators, descramblers, and hacking software.

27.2 Similarly, information in any form on "how to" gain or descramble access to satellite or cable television programming or other services or software programs including access to cloud storage space without authorization or required payment is strictly prohibited. NATION MARKETPLACE's policy is to restrict any encouragement of this type of activity and can lead to suspension and/or termination of membership, in NATION MARKETPLACE’s sole discretion.

 27.3 Devices designed to intentionally block, jam, or interfere with authorized radio communications, including but not limited to such items or services as personal and cellular communication services, wireless networking services (Wi-Fi), global positioning systems (GPS), and police radio scanners allowing access to police communications are prohibited for listing on NATION MARKETPLACE web site.

 

28. SOFTWARE

28.1 Academic Software

Academic software is software sold to teachers, students, and employees of accredited learning institutions. Do not list any academic software unless you are authorized. For listings of academic software in support of an official academic reseller or an educative institution, such licensure needs to be stated or displayed on the product page. Failure to comply will result in the removal of the product. 
 

28.2 OEM Software

Do not list "bundled" or "OEM" software copies on the NATION MARKETPLACE web site, including any listings of License Key Codes to allow use of a device or its software, unless you are promoting it with actual computer hardware and are licensed to do so. Original Equipment Manufacturer (OEM), or bundled software, is software that is obtained as a part of the purchase of the latest computer. OEM software licenses typically restrict the new buyer from reselling the software program without the computer or, in most cases, without the computer hardware.

 

29. SPY EQUIPMENT

29.1 The listing for sale or trade of spy equipment, including any audio or video surveillance or recording device or software considered as commercial spy equipment, is prohibited on the NATION MARKETPLACE web site.  Basic camera devices used for residential home or commercial security protection may be listed when the manufacturers intent to produce such products are not spy intended. Products similar to doorbell cameras; bundled camera kits used for home security or convenience store security are allowed to be listed.

29.2 The listing for sale or trade of any device or software used for interception of wire, electronic, and oral communications is prohibited on the NATION MARKETPLACE web site.

 

30. STOLEN PROPERTY

30.1 The sale or posting of stolen property is strictly forbidden on the NATION MARKETPLACE web site, and violates international law. Stolen property includes items taken from private individuals, as well as property taken without written authorization from companies or governments. 

30.2 NATION MARKETPLACE cooperates with and supports the efforts of law enforcement involving the recovery of stolen property and the prosecution of responsible individuals. If you are concerned that the images or/and text in your item description have been used by another NATION MARKETPLACE web site User without your authorization, or that your intellectual property rights have been violated by such User, please contact our Customer Service team. 


31. TEXTILE QUOTA

31.1 The sale, trade, or purchase offering textiles that exceeds any government-imposed trade restrictions on “textile quota(s)” is strictly prohibited during the restrictive period a quota is in effect. The NATION MARKETPLACE does not monitor international quota restrictions and therefore shall not be liable for any damages or penalties imposed by any government or third party.  It is the Supplier’s responsibility to monitor the laws and regulations affecting their business and industry.

 

32. TRANSIT RELATED ITEMS

32.1 The following items related to the commercial airline and all other commercial transportation industries, and any other public transportation industries may not be listed on the NATION MARKETPLACE web site:

Any article of identification or clothing related to transportation industries, including but not limited to, commercial airport service personnel uniforms, airline pilots’ uniforms, flight attendants’ uniforms, uniforms related to railway industries, and uniforms of security personnel of public transport industries. Vintage clothing related to commercial airlines or other public transport may be listed on the web site provided the item description clearly states that the item is at least ten (10) years old, is no longer in use by the airline or other public transport authority, and does not resemble any current uniform.
 

32.2 Other materials or manuals related to public transportation concerning mass commercial, including entities operating subways, commercially published safety manuals by airlines or buses or trains are not permitted on the NATION MARKETPLACE web site. Such products may be listed solely if the description states clearly that the item is obsolete and no longer in use by the airline or any other transit authority.

32.3 Any internal, official, or/and non-public documents may not be listed for sale or trade on the NATION MARKETPLACE web site.

32.4 These prohibitions relate to all such transportation industries, including ferries, tour boats/ships, and all commercial delivery and transport vehicles and industries, including but not limited to freight containers, shipping containers, shipping pallets and skids plus the associated flatbed trucks, cranes and any other transportation industry items used in the transportation industry including shipping, carrying, or touring industries.
 

33. UNAUTHORIZED COPIES OF INTELLECTUAL PROPERTY

33.1 The sale or listing of unauthorized (duplicated, pirated, bootleg, backup, etc.) copies of software programs, music albums, video games, television programs, photographs, movies, videos, books, treatises, poetry or any written works, including handwritten or digital notes, designs, lyrics, music scores, or ideas for such items, or other protected works is prohibited on the NATION MARKETPLACE web site.

 

34. USED CLOTHING AND COSMETICS

34.1 The listing of used clothing and used cosmetics is not permitted for sale or trade on the NATION MARKETPLACE web site.

 

35. VETERINARY PRODUCTS AND DRUGS FOR ANIMALS

35.1 Prescription veterinary products and drugs may not be listed on the NATION MARKETPLACE web site.

 

36. WILDLIFE AND ANIMAL PRODUCTS

36.1 The sale, trade, or listing of any animal (containing any parts of animal such as skins, pelts, internal organs, claws, teeth, shells, tusks, ivory, bones, and other parts), in any state or condition, including cut, chopped, ground, or any other state or condition, which animal or animal parts are protected by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or any other international, local law or regulation are strictly forbidden on the NATION MARKETPLACE web site. If the Supplier has any questions regarding a listing, please contact our Customer Care team.

 36.2 The sale, trade, or listing of products made with any part of and/or containing any ingredient derived from sharks or marine mammals is prohibited on the NATION MARKETPLACE web site.

 36.3 The sale, trade, or listing of products made from cats or dogs, bears, and any processing equipment to obtain or derive such products are prohibited on the NATION MARKETPLACE web site.

36.4 The sale, trade, or listing of live poultry, livestock, and pets for commercial purposes is not permitted on the Site. 

36.5 If a Customer has any questions regarding a product related to animals and whether it can be listed on the NATION MARKETPLACE web site, please contact our Customer Service team.

 

37. EMBARGOED, SANCTIONED COUNTRIES AND PROHBITED ITEMS

37.1 Products prohibited by sanctions, laws, regulations, including textile quotas and trade restrictions in any relevant jurisdiction or country worldwide are strictly forbidden on the NATION MARKETPLACE web site.

The U.S. export regulations restrict imports and exports to certain destinations without a U.S. Government authorization (called "Licensee"). Current U.S. embargo sanctions (CRIMEA - REGION OF UKRAINE, RUSSIA, CUBA, IRAN, NORTH KOREA, and SYRIA) prohibit ALL transactions (including imports and exports) without a license authorization.
